I have created a couple of facts that are Post-death but when I go into 'Working with Fact Sets', click on the fact and go to properties the 'Normal Time Frame' box is greyed out. How can I change it?

I wonder if the fact set is in V4 format or an early beta 5 format.
Try exporting the Fact Set and importing it again, or create a new fact set and create a fact is the time scale protected on that one?

If I do either of those what would happen to existing records that have the fact in them, do those facts disappear or do they stay put?

The facts will stay in the gedcom, it's only the 'Fact Set' you are working with.

To expand on what Jane is saying, the Fact Tags in your GEDCOM database are quite independent from the Fact Set definitions.
You could delete all your Fact Set definitions and you would notice only a few changes in the way your data is displayed.
What Fact Sets do is give the Fact Tags an operational context.
e.g.
They define the Sentence template for Narrative Reports.
They define the Normal Time Frame for checking Dates.
They allow fields such as Date, Age, Place to be hidden on the Facts tab.
